Terms of Use

These Terms of Use govern your access to and use of Nkyea websites, mobile applications, language-learning content, subscriptions, Organization Access and related services.

1. About Nkyea

Nkyea provides language-learning software, educational content and related services designed to help learners understand, practise and speak African languages, including Twi.

2. Eligibility and accounts

You may use Nkyea only if you are legally permitted to do so in your location and can enter into a binding agreement. Where required by law, a parent, guardian or other legally authorized adult must approve use by a person who cannot enter into the agreement independently.

You are responsible for keeping any account credentials secure and for activity carried out through your account. Notify Nkyea promptly if you believe your account or access credentials have been compromised.

3. Nkyea services

Nkyea services may include phrase learning, native or recorded audio, pronunciation support, speaking practice, Missions, flashcards, Favorites, progress features, challenges, reminders, organization access and other learning tools.

Features may be added, changed, improved, replaced or discontinued as the product evolves. Availability may differ by device, operating system, language, territory, subscription status or organization program.

4. Consumer subscriptions and free trials

Nkyea may offer monthly, yearly or other subscription options through Apple's App Store. The price, subscription period, introductory offer and free-trial terms shown by Apple at the time of purchase form part of the purchase terms.

Where a 7-day free trial or another introductory offer is displayed, eligibility may depend on your Apple account, subscription history, territory and the offer available at that time. Unless the purchase screen states otherwise, an auto-renewable subscription continues for successive periods until cancelled through your Apple account.

Nkyea does not control Apple's billing system, App Store eligibility rules or the timing of charges processed by Apple. Review the purchase confirmation shown by Apple before subscribing.

5. Organization Access

Nkyea may provide annual or other fixed-period access to universities, schools, churches, diaspora associations, cultural organizations, companies, NGOs and other groups.

Organization Access may be governed by a quote, invoice, order form, pilot agreement or separate written agreement specifying learner count, access period, pricing, payment terms, activation, support, reporting and other agreed services.

If a separate written agreement between Nkyea and an organization conflicts with these Terms, the separate agreement controls for that organization's purchase to the extent of the conflict.

6. Access and offer codes

Nkyea may distribute Apple subscription offer codes or other access credentials to eligible individuals or participating organizations. Codes are intended only for the person, organization or cohort for which they were issued.

Unless Nkyea expressly permits it in writing, codes may not be sold, resold, auctioned, exchanged for value, published publicly, shared outside the intended group or used fraudulently.

Redemption eligibility, availability, expiration and subscription behavior may also be subject to Apple's App Store rules. Nkyea may deactivate or replace organization-distributed codes where reasonably necessary to address misuse, administrative errors, fraud or program changes, subject to any applicable agreement and law.

7. Payments, renewals and refunds

Consumer purchases made through the App Store are billed by Apple and are subject to Apple's payment, renewal, cancellation and refund processes. Eligible subscriptions can be managed using the subscription controls associated with your Apple account.

Organization purchases invoiced directly by Nkyea are payable according to the applicable quote, invoice, order form or agreement.

Nothing in these Terms removes refund, cancellation, cooling-off or other consumer rights that apply under mandatory law.

8. Your right to use Nkyea

Subject to these Terms and any applicable subscription or organization agreement, Nkyea grants you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the services for lawful learning, educational or approved organizational purposes.

This permission does not transfer ownership of the app, software, recordings, text, curriculum, designs or other Nkyea materials to you.

9. Nkyea content and intellectual property

Nkyea and its licensors retain all rights in the Nkyea name, branding, software, interface, lesson structures, audio, text, translations, phrase collections, illustrations, graphics and other original content, except where another owner is identified.

You may not copy, reproduce, scrape, systematically extract, republish, distribute, sell, sublicense or commercially exploit substantial portions of Nkyea content without prior written permission, except where applicable law expressly permits the activity.

10. Acceptable use

You agree not to misuse Nkyea. In particular, you must not:

  • attempt to gain unauthorized access to Nkyea systems, accounts or data;
  • interfere with or disrupt the operation, security or integrity of the services;
  • use automated tools to scrape or harvest substantial amounts of Nkyea content without permission;
  • circumvent technical restrictions except where applicable law expressly allows it;
  • use Nkyea to infringe another person's rights or violate applicable law;
  • misrepresent your identity, organization or eligibility for Organization Access; or
  • share, resell or misuse subscription or organization credentials contrary to these Terms.

11. Speaking and AI-assisted features

Some Nkyea features may analyse speech, generate feedback, provide pronunciation guidance or use automated or AI-assisted systems. These tools are intended for educational practice and should not be treated as a perfect or authoritative assessment of a person's language ability.

Automated feedback may occasionally be inaccurate, incomplete or inconsistent. Learners should use it as one learning signal alongside native audio, contextual notes, instruction and real-world communication.

12. Privacy and data

Nkyea's collection and use of personal information is described in the Privacy Policy. That policy should be read together with these Terms.

Where Nkyea provides aggregate organization reporting, the applicable product description or organization agreement may describe the categories of engagement information made available to the participating organization.

13. Third-party services

Nkyea may rely on third-party platforms and service providers, including Apple for App Store distribution, purchases and subscriptions. Certain features may also depend on hosting, analytics, speech, communications or other technology providers.

Your use of a third-party service may also be governed by that provider's terms and privacy practices. Nkyea is not responsible for a third party's independent services, policies or actions except to the extent required by applicable law.

14. Availability and changes

Nkyea aims to provide a reliable service, but uninterrupted or error-free availability cannot be guaranteed. Maintenance, software updates, connectivity, device limitations, third-party outages and other events may temporarily affect access.

Nkyea may modify features or content where reasonably necessary to improve the service, respond to technical or legal requirements, protect users or develop the product.

15. Disclaimers

Nkyea is an educational product. Learning outcomes vary between users and depend on factors such as practice, prior knowledge, frequency of use and real-world exposure. Nkyea does not guarantee fluency, examination results, employment outcomes or any particular level of proficiency.

To the fullest extent permitted by applicable law, the services are provided on an "as available" basis. Warranties or guarantees that cannot legally be excluded remain unaffected.

16. Limitation of liability

To the fullest extent permitted by applicable law, Nkyea will not be liable for indirect, incidental, special or consequential loss arising solely from your use of, or inability to use, the services.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law.

17. Suspension and termination

Nkyea may suspend or restrict access where reasonably necessary to address fraud, security risks, material breaches of these Terms, unlawful activity, misuse of organization codes or threats to the service or other users.

Where appropriate, Nkyea will consider the seriousness of the issue and any applicable contractual or legal requirements before terminating paid access.

18. Changes to these Terms

Nkyea may update these Terms as the services, business model or legal requirements change. The latest version will be posted on this page with an updated effective or revision date.

If a change materially affects an existing paid service or your legal rights, Nkyea will provide any notice required by applicable law.

19. Governing law and disputes

These Terms are intended to operate under the laws applicable to Nkyea's legal business entity, subject to mandatory consumer protections or jurisdictional rights that apply where you live.
